Terms of use

The basis for using AdviserPro: what we provide, what you control and the responsibilities we each retain.

1. About these terms

These terms describe access to and use of AdviserPro, provided by Adviser Edge Limited trading as AdviserPro (“we”, “us” or “our”). “Services” means our website, applications and related features. “Customer” means the adviser business that arranges access; “user” means a person authorised to use the Services.

When you accept these terms as part of arranging or accessing the Services, they form part of your agreement with us. If you accept for a business, you must have authority to bind it. Do not access a workspace without the Customer’s permission.

A separate written agreement with us takes priority to the extent it expressly varies these terms. Applicants invited to provide information are not, merely by using a portal, agreeing to buy a subscription or assuming their adviser business’s financial obligations.

Our privacy policy explains how personal information is handled. Acceptance of these terms is not a substitute for any specific permission required to connect an account or process information.

2. What AdviserPro provides

AdviserPro supports mortgage-adviser operations, including intake, fact-find, document collection and review, workflow assistance and meeting scheduling. The features available to a Customer depend on the access and services agreed with us.

We provide software assistance, not financial, legal, tax or credit advice. AdviserPro does not act as the applicant’s adviser or lender, guarantee a lending outcome, or certify that an application satisfies every legal or lender requirement.

Features identified as a trial, preview or evaluation may change and have additional limitations explained when access is arranged. Use only synthetic or expressly approved test data in evaluation workspaces unless we have separately authorised real-client use.

3. Accounts and authorised access

Provide accurate account information, protect your sign-in access and promptly report suspected misuse. Do not share access in a way that bypasses individual permissions. The Customer is responsible for deciding which staff should have access and requesting changes when roles or employment change.

Use only information and functions you are authorised to access. You must not assume that technical access to a record gives you permission to use it for another purpose.

4. Professional responsibility and human review

The Customer and its advisers remain responsible for obtaining required authorities, checking source information, giving advice, complying with professional obligations and deciding what to communicate or submit to a lender.

Review generated summaries, document checks, proposed communications and actions before relying on them. An automated status or suggested next step does not amount to legal compliance, acceptance of a document, a lending recommendation or approval of an application.

Maintain the records and business-continuity arrangements appropriate to your obligations. These responsibilities do not remove our duties to provide the Services in accordance with our agreement and applicable law.

5. AI-assisted features

AI-assisted features use relevant requests and information to generate checks, summaries and proposed actions. Their outputs may contain errors, omissions or unsupported conclusions and may differ when the same task is repeated.

Check outputs against the source material and your professional judgement. Do not present unreviewed AI output as a final professional decision. We do not guarantee the accuracy, uniqueness or suitability of every generated result.

Using an AI feature may involve processing by a service provider, as explained in the privacy policy. Calendar information is used for scheduling, not creditworthiness assessment or lending decisions. The assistant seeks confirmation before diary changes and other actions for which approval is required.

6. Calendars and other connected services

Connecting an external account is optional. You must be authorised to connect it and should review the provider’s requested permissions and terms. The account owner or their organisation may limit or withdraw that access.

AdviserPro uses the granted access to carry out the supported actions you approve. Check meeting details, time zones and recipients before confirming. Sending invitations is an explicit choice. Existing events and delivered invitations are not automatically removed when you disconnect.

External providers control their own availability, permissions and processing. We do not guarantee their uninterrupted operation, but remain responsible for our own obligations in providing the integration. Calendar help explains connection and removal of access.

Address autocomplete uses Google Maps Platform. Address suggestions are subject to the Google Maps terms and Google’s privacy policy. You can enter an address manually if you do not want to use the suggestion service.

7. Your information and permissions

You or the relevant rights holder retain rights in information supplied to AdviserPro. You give us a limited permission to host, process, reproduce and transmit it as necessary to provide and support the agreed Services, using the service providers described in our privacy policy. This is not a transfer of ownership.

The Customer must have a lawful basis and any required authority to provide applicant information, including information about co-applicants and dependants. It must provide required notices and ensure its users follow those permissions. We remain responsible for privacy obligations that apply to us.

Do not upload material that infringes another person’s rights or is unnecessary for the task. If you authorise sharing, recipients may retain independent copies subject to their own obligations; withdrawing access cannot undo a disclosure already made.

8. Platform intellectual property

AdviserPro’s software, design, branding and other platform materials belong to us or our licensors. Subject to the agreement, authorised users may use them to receive the Services. No ownership of our platform is transferred.

Except where permitted by law or our written agreement, do not copy, resell, reverse-engineer or distribute the platform, extract proprietary components, or use our branding in a way that suggests an endorsement. This does not restrict your rights in your own information or lawful use of outputs delivered for your workflow.

9. Acceptable use

You must not use the Services to mislead applicants, impersonate another person, submit unlawful material, infringe rights, send unsolicited communications or misuse another person’s information.

Do not bypass access controls, introduce malicious content, scrape private records, attempt unauthorised security testing, or disrupt the service. Automation must use an authorised integration or an arrangement agreed with us. Report suspected vulnerabilities privately to support without accessing other people’s information.

10. Fees and service arrangements

Any fees, payment dates, usage allowances, renewal arrangements and cancellation conditions must be stated in the offer or agreement the Customer accepts. These terms do not create a paid subscription, automatic renewal or payment obligation merely because someone visits the website or receives a portal invitation.

Additional charges or material commercial changes require the notice and agreement applicable to the arrangement. Any refund rights required by law continue to apply.

11. Availability and changes to the service

We use reasonable care in providing the Services. Maintenance, external dependencies and other events can cause interruptions or delays. Unless separately agreed, we do not promise uninterrupted access, a particular response time or a specific business outcome.

We may improve or change features. Where a change materially reduces an agreed paid service, we will give reasonable notice where practicable and discuss an appropriate remedy, subject to the agreement and applicable law. Evaluation features may be changed or withdrawn under the conditions explained when access is arranged.

12. Liability and legal rights

Nothing in these terms excludes or restricts rights, remedies or responsibilities that cannot lawfully be excluded. This includes applicable statutory guarantees and our own privacy obligations. Describing the limitations of AI or a connected provider does not remove responsibility for our own breach of duty.

To the extent permitted by law, we are not responsible for loss caused by inaccurate information supplied to us, use outside the agreed purpose, unauthorised actions by a user, or an adviser’s independent professional decision, except to the extent our own breach, negligence or wrongful act contributed to that loss.

For Customers acquiring the Services in trade, and only to the extent lawful and fair in the circumstances, neither party is liable to the other for indirect or consequential loss arising under the service agreement. This does not exclude direct loss merely because it involves lost data or business disruption, and does not limit liability for fraud, deliberate wrongdoing or liability that the law does not allow to be limited.

Any financial cap or additional allocation of business liability must be expressly set out in a separate written agreement. Both parties should take reasonable steps to avoid or reduce a loss. These terms do not impose an unlimited indemnity on applicants or require a user to compensate us for our own wrongdoing.

13. Suspension, closure and information requests

We may restrict access where reasonably necessary to address a serious security risk, unlawful use or material breach. Where it is safe and practical, we will explain the issue and allow a reasonable opportunity to resolve it. An urgent protective restriction may take effect immediately.

A Customer may request closure through support, subject to any separately agreed service period or payment obligations. An individual user may ask to end their access; that does not automatically terminate the Customer’s agreement or delete shared business records.

We will work with the Customer on reasonable arrangements for access to its records when a service ends, subject to legal and security requirements. Deletion requests and any remaining copies are handled under our privacy policy. Account closure is not a representation that all information has already been erased.

14. Concerns, disputes and governing law

Contact support with a description of the concern so we can try to resolve it in good faith. If a business dispute remains unresolved, the parties may agree to mediation before commencing proceedings.

New Zealand law governs these terms. Subject to any mandatory rights to use another court or tribunal, the courts of New Zealand have jurisdiction. Nothing prevents seeking urgent relief, contacting a regulator, or exercising a statutory complaint or remedy.

15. Changes to these terms

We may update these terms to reflect changes in the Services, our arrangements or legal requirements. We will give affected Customers reasonable advance notice of material changes where practicable, explain when they apply, and obtain agreement where required. Urgent legal or security changes may require shorter notice.

A change does not remove rights already accrued or retrospectively authorise a new use of personal information. If a material change is not acceptable, contact us before it takes effect to discuss continued use or closure under the applicable agreement.

16. Contact and general provisions

Contact Adviser Edge Limited trading as AdviserPro, New Zealand, at support@adviserpro.co.nz for questions about these terms.

If a provision cannot be enforced, the remaining terms continue to apply to the extent they can operate lawfully. A delay in enforcing a right does not waive it. Any agreed order or service agreement and these terms should be read together; they do not displace mandatory legal rights.
